1. INFORMATION WE MAY COLLECT
Where applicable, we indicate whether and why you must provide us with your Personal Information, as well as the consequences of failing to do so. If you do not provide Personal Information when requested, you may not be able to benefit from our Platform if that information is necessary to provide you with the service or if we are legally required to collect it.
1.1 Personal Information and Non-Personal Information Provided by You at Registration
If you desire to have access to certain restricted sections of the Site or request to receive marketing materials, you may be required to become a registered user, and to submit the following types of Personal Information to Sales Innovator: your full name, email address, password, and IP address.
the users who have “client” accounts may need to submit additional contact information, project details, and project requirements all of which may contain Personal Information;
the users of “freelancer” accounts may need to submit additional contact information, information about their skills, and payment preferences;
the users of who have “Platform services and tools” accounts may need to submit a user name.
1.2 Personal Information Provided by You Voluntarily
If you submit any feedback or review about the Platform or our services (“Feedback”), you hereby assign to Sales Innovator all rights in the Feedback and agree that Sales Innovator shall have the right to use such Feedback and related information in any manner it deems appropriate. Sales Innovator will treat any Feedback you provide to us as non-confidential and non-proprietary. You agree that you will not submit to us any information or ideas that you consider to be confidential or proprietary.
We may collect information through your communications with our customer support team or other communications and Feedback that you may send us.
In order to allow you to post to your social media platforms, we may ask you to provide your username, account ids, social handle, time zones, and email address.
We may also collect your contact details when you provide them in the context of our customer, vendor, and partner relationships.
Data you make public: We may collect or obtain your Personal Information that you manifestly choose to make public, including via social media (e.g., we may collect information from your social media profile(s), if you make a public post about us).
App data: We may collect or obtain your Personal Information when you download or use any of our Apps.
Site data: We may collect or obtain your Personal Information when you visit any of our Sites or use any features or resources available on or through a Site.
Content and advertising information: If you choose to interact with any third party content or advertising on a Site or in an App, we may receive Personal Information about you from the relevant third party.
Third party information: We may collect or obtain your Personal Information from third parties who provide it to us (e.g., credit reference agencies; law enforcement authorities; etc.).
1.3 Personal Information Collected from Connected Social Media Accounts
If you connect your third party social media account to your Sales Innovator account, we may collect certain information stored in your social media account such as:
Sales Innovator may allow you to connect a LinkedIn profile to your Sales Innovator account, in which case we will access certain information from LinkedIn regarding your account. In particular, we may collect profile image, display name, username / profile ID, access tokens, and sent posts. This includes the content of your post and engagement data (such as click rates, likes, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Sales Innovator to provide you with the Platform you expect and will not be shared with any third parties.
Sales Innovator may allow you to connect a Google+ page or profile to your Sales Innovator account, in which case we will access certain information from Google regarding your account. In particular, we may collect profile image, display name, username / profile ID, access tokens, and sent posts. This includes the content of your post and engagement data (such as click rates, likes, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Sales Innovator to provide you with the Platform you expect and will not be shared with any third parties.
Additionally, if you connect Twitter, Facebook, or Instagram when utilizing Sales Innovator Reply we may collect: profile image, display name, username / page ID, access tokens, sent or received comment text and sent or received private message text.
Additionally, if you connect Twitter, Facebook, or Instagram when utilizing Sales Innovator Analyze we may collect: profile image, display name, username / handle, access tokens, social accounts insights data and social accounts demographic data, sent tweets, social account’s followers count, social account’s insights data and social account’s audience data.
Sales Innovator application use and transfer to any other app of information received from Google Accounts will adhere to Google API Platforms User Data Policy https://developers.google.com/terms/api-services-user-data policy#additional_requirements_for_specific_api_scopes, including the Limited Use requirements.
1.4 Personal Information Automatically Obtained from Your Interactions with the Platform
When you use our Platform, our servers automatically record information that your browser sends whenever you visit a website (“Log Data”). This Log Data may include information such as your IP address, browser type or the domain from which you are visiting, the web-pages you visit, the search terms you use, and any advertisements on which you click.
Cookies and Similar Technologies
Like many websites, we also use “cookie” technology to collect additional website usage data and to improve the Site and our Platform. A cookie is a small data file that we transfer to your computer’s hard disk. A session cookie enables certain features of the Site and our service and is deleted from your computer when you disconnect from or leave the Site. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Site. Persistent cookies can be removed by following your web browser help file directions. Most Internet browsers automatically accept cookies. Sales Innovator may use both session cookies and persistent cookies to better understand how you interact with the Site and our Platform, to monitor aggregate usage by our users and web traffic routing on the Site, and to improve the Site and our Platform.
We may also automatically record certain information from your device by using various types of technology, including “clear gifs” or “web beacons.” This automatically collected information may include your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after you use the Platform, the pages or other content you view or otherwise interact with on the Platform, and the dates and times that you visit, access, or use the Platform. We also may use these technologies to collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message, to the extent permitted under applicable law.
You can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. Please note that if you delete, or choose not to accept, cookies from the Platform, you may not be able to utilize the features of the Platform to their fullest potential.
1.5 Email Access: Information Collected via Your Email Accounts (for users of Platform services and tools only)
By providing your credentials, you are consenting to give us access to your email(s) for the purpose of sending emails on your behalf and storing replies to those emails.
Our servers only store emails that you have sent via Sales Innovator and any responses you have received to those emails so we can detect replies, classify them, and provide access to them in your Sales Innovator account. All data obtained via your email accounts is available in your Sales Innovator account. We ensure that our employees do not have access to the content of your emails and that all emails are encrypted. However, we may aggregate statistical data about usage or bounced emails and reserve the right to use this data for any purpose.
We will store your authentication token and account email address. This data will be securely stored to be used by Sales Innovator to provide you with the Platforms (including but not limited to logging into your account, sending emails via the Sales Innovator platform, accessing emails you sent, and viewing replies you received to these emails). Under no circumstances will this data be voluntarily shared with any third parties; Sales Innovator could only provide this information to legal authorities upon their lawful request. Should you choose to disconnect your email account or decide to close your account, any information from your email provider that is stored on our servers will be removed permanently within thirty (30) days.
At Sales Innovator, we do not use data obtained from our users (from their email accounts) for advertising purposes; this includes personalized, re-targeted, and interest-based advertising.

2. HOW WE MAY USE YOUR PERSONAL INFORMATION
We may use the Personal Information we obtain about you to:
create and manage your account, provide our Platform, process payments, and respond to your inquiries;
manage account authentication such as two-factor authentication
communicate with you to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance, including by periodically emailing you service-related announcements;
provide tailored advertising, for Sales Innovator services, via Google AdWords;
aggregate your Personal Information for analytical purposes;
provide customer support;
operate, evaluate and improve our business (including by developing new products and services; managing our communications; determining the effectiveness of our advertising; analyzing how the Platform is being accessed and used; tracking performance of the Platform; debugging the Platform; facilitating the use of our Platform);
send you marketing communications about products, services, offers, programs and promotions of Sales Innovator, and affiliated companies;
ensure the security of our Platform;
manage our customer, service provider and partner relationships;
enforce our agreements related to our Platform and our other legal rights; and
comply with applicable legal requirements, industry standards and our policies.
If you are located in the European Economic Area, we may process your Personal Information for the above purposes when:
you have consented to the use of your Personal Information, For example, we may seek to obtain your consent for our uses of cookies or similar technologies, or to send you marketing communications.
we need your Personal Information to provide you with services and products requested by you, or to respond to your inquiries,
we have a legal obligation to use your Personal Information, or
we have a legitimate interest in using your Personal Information. In particular, we have a legitimate interest in using your Personal Information to ensure and improve the safety, security, and performance of our Platform, to anonymize Personal Information and carry out data analyses.
3. HOW WE SHARE YOUR PERSONAL INFORMATION
We may disclose the Personal Information we collect about you as described below or otherwise disclosed to you at the time the data is collected, including with:
Social Media Platforms
We engage certain trusted third parties to perform functions and provide services to us, including hosting and maintenance, error monitoring, debugging, performance monitoring, billing, customer relationship, database storage and management, and direct marketing campaigns. We may share your Personal Information with these third parties, but only to the extent necessary to perform these functions and provide such services. We also require these third parties to maintain the privacy and security of the Personal Information they process on our behalf.
Compliance with Laws and Law Enforcement
Sales Innovator cooperates with government and law enforcement officials or private parties to enforce and comply with the law. To the extent permitted under applicable law, we may disclose any information about you to government or law enforcement officials or private parties as we believe is necessary or appropriate to investigate, respond to, and defend against claims, for legal process (including subpoenas), to protect the property and rights of Sales Innovator or a third party, to protect Sales Innovator against liability, for the safety of the public or any person, to prevent or stop any illegal, unethical, fraudulent, abusive, or legally actionable activity, to protect the security or integrity of the Platform and any equipment used to make the Platform available, or to comply with the law.

4. HOW WE PROTECT YOUR PERSONAL INFORMATION
Sales Innovator is very concerned about safeguarding the confidentiality of your Personal Information. We employ administrative and electronic measures designed to appropriately protect your Personal Information against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the Personal Information in our possession. Please be aware that no security measures are perfect or impenetrable. We cannot guarantee that information about you will not be accessed, viewed, disclosed, altered, or destroyed by breach of any of our administrative, physical, and electronic safeguards, subject to requirements under applicable law to ensure or warrant information security.
We will make any legally-required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored Personal Information to you via email or conspicuous posting on our Site in the most expedient time possible and without unreasonable delay, consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system, and any other disclosures that may be required under applicable law.
We also take measures to delete your Personal Information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it, unless we are required by law to keep this information for a longer period. When determining the retention period, we take into account various criteria, such as the type of products and services requested by or provided to you, the nature and length of our relationship with you, possible re-enrollment with our products or services, the impact on the services we provide to you if we delete some information from or about you, mandatory retention periods provided by law and the statute of limitations.
5. DO NOT TRACK
Sales Innovator does not process or respond to web browsers’ “do not track” signals or other similar transmissions that indicate a request to disable online tracking of users who use our Platform.

Our Site contains links to third-party websites. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third-party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit Personal Information from you. Other sites follow different rules regarding the use or disclosure of the Personal Information you submit to them. We are not responsible for the content, privacy and security practices of third-party websites or services to which links or access are provided through the Platform. We encourage you to read the privacy policies or statements of the other websites you visit.
8. MAKING A PURCHASE USING OUR PARTNER CHARGEBEE, STRIPE, OR PAYONEER
When you make payments through the Platform you will be redirected to a third-party payment service, ChargeBee, Stripe, or Payoneer. ChargeBee, Stripe, or Payoneer collects your full name, email, billing address and credit card number. However, ChargeBee, Stripe, or Payoneer does not share all of that Personal Information with us except your email address and amount paid.
9. YOUR RIGHTS AND CHOICES
If you decide at any time that you no longer wish to receive such marketing communications from us, please follow the unsubscribe instructions provided in any of the communications. You may also opt out from receiving commercial email from us by sending your request to us by email at email@example.com. Please be aware that, even after you opt out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Platform.
In certain jurisdictions you have the right to request access and receive information about the Personal Information we maintain about you, to update and correct inaccuracies in your Personal Information, to restrict or object to the processing of your Personal Information, to have the information blocked, anonymized or deleted, as appropriate, or to exercise your right to data portability to transfer your Personal Information to another company. Those rights may be limited in some circumstances by local law requirements. In addition to the above-mentioned rights, you also have the right to lodge a complaint with a competent supervisory authority subject to applicable law.
Where required by law, we obtain your consent for the processing of certain Personal Information collected by cookies or similar technologies, or used to send you direct marketing communications, or when we carry out other processing activities for which consent may be required. If we rely on consent for the processing of your Personal Information, you have the right to withdraw it at any time and free of charge. When you do so, this will not affect the lawfulness of the processing before your consent withdrawal.
To update your preferences, ask us to remove your information from our mailing lists, delete your account or submit a request to exercise your rights under applicable law, please contact us as specified in the “How to Contact Us” section below.
10. REQUIRED CONSUMER CONSENTS AND PERMISSIONS
In some countries or jurisdictions, additional consents, notices and permissions may be required for certain types of marketing or processing of personal information. You hereby agree and acknowledge that while Sales Innovator seeks to comply with its own legal obligations, Sales Innovator has not obtained any rights or consents on your behalf: therefore, to the extent that any law or regulation may require that you (in addition to Sales Innovator) provide notice or obtain consent in order to market to any person or process any person’s personal data, you agree that you have to obtain on your own behalf such notices or consents.
11. DATA TRANSFERS
Individuals Located in the EEA or Switzerland
If you are located in the European Economic Area (“EEA”) or Switzerland, we will comply with applicable legal requirements for the transfer of Personal Information to countries outside of the EEA or Switzerland. In addition, we may enter into Standard Contractual Clauses issued by the European Commission with our commercial customers where appropriate.
12. CALIFORNIA CONSUMER PRIVACY ACT
In accordance with the California Consumer Privacy Act, if you are a consumer residing in California the following addition terms apply to you.
12.1 Right to Know About Information Collected, Disclosed or Sold
You have the right to request what Personal Information we collect, use, disclose, and sell. To submit a request, fill out a form which is available at salesinnovator.com/privacy-inquiries or email us at firstname.lastname@example.org.
If you have an account with us, we will verify the request by confirming the email address used to make the request is the same as the email address on file for the account. If you do not have an account with us, we will verify the request by sending an email to the email address used to make the request.
The categories of California consumers’ Personal Information we may collect are listed above in Section 1.
With reference to Section 1 above, we collect the following categories of data from our customers: personal details;; contact details; consent records; purchase details; payment details; data relating to our Sites and Apps; employer details; content and advertising data; and views and opinions of our customers. We use this data for the purposes listed above in Section (4) (“HOW WE MAY USE YOUR PERSONAL INFORMATION”).
We confirm we have not sold any Personal Information to third parties for a business or commercial purpose in the preceding 12 months. We confirm we do not sell Personal Information of minors under 16 years of age without authorization. We may disclose the categories of Personal Information listed in Section 1 to our vendors and service providers for a business purpose.
12.2 Right to Request Deletion of Personal Information
You have the right to request deletion of Personal Information collected or maintained by us. To do so, please submit a request via salesinnovator.com/privacy-inquiries or by emailing us at email@example.com.
If you are a current or former customer submitting a request by email, please provide sufficient information to identify your account, including your email address on file with us. You may be asked to verify your identity by responding to us with the email address on file for the account.
If you are not a current or former customer, we may ask for proof of identity sufficient to show you are the same consumer about whom we have collected Personal Information that you are requesting to be deleted.
12.3 Right to Opt-Out of the Sale of Personal Information
You have the right to opt-out of the sale of your Personal Information by a business. Pursuant to California law, because we do not and will not sell your Personal Information, we do not offer such an opt-out at this time.
12.4 Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights
You have the right not to receive discriminatory treatment by the business for the exercise of the privacy rights conferred by the California Consumer Privacy Act.
12.5 Authorized Agent
If you would like to make a request under the California Consumer Privacy Act on behalf of a California consumer who is a current or former customer, please provide an email from the email address we have on file for the customer authorizing the request.
You may also make a request under the California Consumer Privacy Act on behalf of a California consumer if you provide (1) a signed, written permission from the consumer to act on your behalf, and the consumer verifies their own identity directly with us; or (2) proof that the consumer has provided you with power of attorney pursuant to Probate Code sections 4000 to 4465.
We may deny a request from an agent that does not submit proof that they have been authorized by the consumer to act on their behalf.

13. RIGHTS UNDER GDPR
The European General Data Protection Regulation (“GDPR”) is a regulation in EU law on data protection and privacy for all natural persons accessing the Internet from the European Union and the European Economic Area, whatever their nationality or place of residence is. It also addresses the transfer of personal data outside the EU and EEA areas. Our collection, processing and protecting of Personal Information of those who access the Platform from a European country, is compliant with GDPR.
If you are accessing and using the Platform from the European Union and the European Economic Area, you have the following rights with regard to your Personal Information:
the right of access (you can request us to provide you verbally or in writing with the type of information we store about you and we have a month to respond to your request);
the right to rectify (amend/correct) any Personal Information about you that is inaccurate;
the right to erasure (some conditions apply, see Data Retention section below);
the right to restrict processing your Personal Information, however, if you restrict us from processing a part of your Personal Information that is essential to our provision of the Platform, you may be asked to terminate your Account and stop using the Platform;
the right to data portability (the right to data portability allows users of the Platform to obtain and reuse their Personal Information for their own purposes across different services; you may request us to transmit your Personal Information directly from our servers to another company’s servers and we will do so if it is technically feasible);
the right to object (for example, you have an absolute right to stop us from using your Personal Information for direct marketing - read our opt-out instructions below; you may express your objection verbally or in writing and we have a month to respond to any such objection; we might still continue processing your Personal Information if we are able to show that we have a compelling reason for doing so);
the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or that affects you significantly.
We represent and warrant that your Personal Information is:
processed lawfully, fairly and transparently;
collected only for specific legitimate purposes;
collection of personal data is adequate, relevant and limited to what is necessary;
accurate and kept up to date (with your help);
stored only as long as is necessary; and
is secure and kept in confidence.
Data Retention: Generally, your Personal Information will be erased when (i) it is no longer needed for its original processing purpose, (ii) you withdraw your consent for us to store by deleting your Account, (iii) there is no preferential justified reason for the processing of your Personal Information and you object to our processing of your Personal Information, or (iv) erasure of your Personal Information is required in order to fulfil a statutory obligation under the EU law or the right of the EU Member States. Therefore, we will make sure your Personal Information will be erased under all of the above-mentioned circumstances. You may request us to erase your Personal Information verbally or in writing and we have one (1) month to respond to any such request.
Data Breach Notification: Should there be a personal data breach leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Personal Information transmitted, stored or otherwise processed, we will notify you and appropriate supervisory authority without undue delay and, where feasible, not later than seventy-two (72) hours after having become aware of it.
14. CHILDREN’S PRIVACY
The Platform is not directed to persons under 16. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at email@example.com. We do not knowingly collect Personal Information from children under 16. If we become aware that a child under 16 has provided us with Personal Information, we will delete such information from our files.
